What are commonly called small-claims cases (cases heard in the Provincial Court of Alberta – Civil Division) are not necessarily ‘small’ in Alberta by the standards of other jurisdictions.  Claims up to a value of $50,000.00 may be heard and the jurisdiction exists to rule on most types of claim.

The same level of detail, preparation and planning is necessary in a small-claims case as a larger case.

Knowledge of the prevailing rules and laws of evidence is most beneficial.  Some rules differ from the rules in other courts.  Some do not.

In appropriate cases, we are able to assist in these matters short of full representation.  In others we will represent you in the ordinary way.

Some common matters seen in Provincial Court (small-claims) on which we assist are:

  • Construction disputes
  • Contract disputes
  • Insurance matters
  • Injury matters
  • Bad or aging debt matters
  • Landlord and tenancy disputes
  • Sale of goods and warranty matters
  • Property damage
  • Nuisance
  • Product liability

Small-claims matters often require:

  • Determining whether a claim is within the jurisdiction of the Provincial Court
  • Identifying the proper parties
  • Drafting a claim appropriately under the Rules
  • Organizing service
  • Gathering and presenting evidence
  • Navigating mediation and pre-trial conferences
  • Dealing with experts
  • Organizing evidence
  • Advising on settlement
  • Conducting Trials
  • Enforcing Judgments
